The attorneys for a Fort Wayne man accused of murder in Paulding County have filed a motion to dismiss the case on Monday in Paulding County Common Pleas Court. Defense attorneys filed a motion to dismiss for lack of territorial jurisdiction in the case involving 34 year olde Daniel Zerbe of Fort Wayne. Zerbe has been charged with murder, with a firearm specification relating to the death of Wilma Schwartz. Zerbe has pleaded not guilty to the charge. The body of Schwartz was discovered on Road 1 near Antwerp on March 14, 2016. Authorities believe Schwartz, who died from a single gunshot wound to the head, was shot inside her vehicle, which was later found in Huntington County, Ind. Authorities have stated that Zerbe and Schwartz were believed to have been in a relationship.
