The man accused in Bryan Municipal Court of pouring soap in the Bard Centennial Fountain was on the stand Friday. Zachary Perez testified that this is a case of mistaken identity and the photo of a man at the fountain is not him. Perez was arrested in October and charged with criminal damaging. His lawyer pointed out a lack of motive and questioned the officials responsible for the fountain’s ability to assess the damage. Finally, he says the substance was not tested by police and found to be soap. Perez has a bench trial, meaning no jury. The Judge, Kent North, has not rendered his verdict.
